[04/28/2009] On March 13, 2009, Tamela J. White and Marvin “Chip” Capehart, II received a defense verdict in the week-long trial of a medical malpractice case in the Circuit Court of Logan County, West Virginia. The case, defended on behalf of a Logan-based general surgeon, involved an alleged failure to timely diagnose and treat a ruptured appendix, which failure, in turn, was alleged to have resulted in the formation of a clot of the femoral artery. The defendant made no pre-trial offer of settlement.
